1. General points and validity of the general terms and conditions

1.1 The general terms and conditions (hereinafter referred to as General Terms and Conditions) regulate the comprehensive terms and conditions and services between Schrader GmbH (hereinafter referred to as floki24.ch) and your customers.
1.2. Deviations from these terms and conditions are only effective if made in writing floki24.ch were confirmed.

1. Product offering

2.1. All offers on the webshop from floki24.ch are subject to change and not binding. An order is only concluded through the order confirmation via email. Subject to availability of the items.
2.2. The information in the sales documents (drawings, illustrations, dimensions, weights and other services) are approximate and are to be understood as guidelines and do not represent a binding guarantee.

1. Prices and payment terms

3.1. All prices from floki24.ch are shown in CHF and are subject to change. The prices include the statutory Swiss value added tax (VAT).
3.2. Technical changes, errors and printing errors remain reserved.
3.3. Price changes can be made by floki24.ch always and without prior notice.

3.4. Delivery is only made against advance payment.

3.5. Payments must be received within 10 days. Until then, the item remains reserved for the customer. After the payment period has expired, it stands floki24.ch Free to cancel the order and put the item back on sale.

3.6. Depending on the payment method chosen, which can be selected during the ordering process, fees apply.

3.7. Purchase on account with partial payment option (POWERPAY)
MF Group / POWERPAY, as an external payment service provider, offers the payment method “purchase on account”. With the individual invoice you can easily pay for your online purchase by invoice. If you decide not to pay within the specified time frame, you will subsequently receive a monthly invoice with an order overview in the following month.
When the purchase contract is concluded, POWERPAY takes over the resulting invoice claim and handles the corresponding payment modalities. When purchasing on account, you accept in addition to our General Terms and ConditionsTerms and Conditionsfrom POWERPAY. (powerpay.ch/de/agb).

1. Shipping costs

4.1. floki24.ch delivers all items listed in the online shop free of charge in Switzerland. Abroad on request.

1. Delivery

5.1.  Delivery takes place exclusively by mail. Collection of the ordered goods is possible upon request (and after payment in advance) in Kreuzlingen.

5.2. The stated delivery time is to be understood as a guideline. If the delivery time cannot be met, the customer will be informed and is free to withdraw from the purchase contract. Further claims cannot be asserted.

5.3. Confirmed orders can be canceled due to external circumstances beyond our control floki24.ch can be canceled without any costs.

1. Transport damage

6.1. All packages are automatically insured up to a value of 500,00 francs. Transport damage must be reported in writing by email as soon as it is discovered. The damage must be documented in writing (by email) with photos of the inner packaging and outer packaging, as well as the defect.

The claim for compensation lapses if written notification as described above is not received within 4 calendar days of receipt of the goods floki24.ch have been received.

6.2. Delivers in the event of transport damage floki24.ch free replacement or a price reduction will be offered. Change is impossible.

1. Warranty

7.1. The warranty is 2 years and begins on the delivery date. Self-inflicted defects and/or defects caused by improper use, handling, storage or transport are excluded.

Insignificant deviations from the guaranteed properties of the goods do not trigger any warranty rights. Liability for normal wear and tear, as well as consumables, accessories, enclosed batteries, accumulators, strings and the like is excluded.

7.2. Warranty claims against floki24.ch are only available to the direct buyer and cannot be assigned.

7.3. The buyer has the exclusive right to repair or exchange. The decision to repair or replace an item rests with you floki24.ch. The buyer bears the shipping costs for the return. Change is impossible.

1. Returns, exchanges, cancellation of orders

8.1. floki24.ch offers a 14-day right of return or exchange. A return of products by the customer requires the prior consent of floki24.ch.

8.2. The return period is 14 calendar days and begins with receipt of the order. The return must be received by the 14th calendar day after receipt of the order floki24.ch have been received. An extension is not possible.

8.3. The item must be returned complete, unused and in its original packaging. Improper items or packaging will not be accepted.

The sender is liable for damage during return transport. The return shipping costs are borne by the buyer.

8.4. Since shipping is free, a shipping cost of 20% will be retained from the purchase price when goods are returned. 80% is transferred back to the customer.

1. Limitation of Liability

9.1. You are obliged to comply with these General Terms and Conditions and the other contractual provisions floki24.ch to the customer for the careful provision of the services.
9.2. Claims for damages arising from impossibility of performance, from breach of contract, from negligence in concluding the contract and from unlawful acts are excluded against us as well as against our vicarious agents or vicarious agents, unless there is intentional or grossly negligent action.
9.3. Liability for indirect damages and consequential damages resulting from use, incorrect performance or loss of performance is excluded.

1. Data protection

10.1. floki24.ch is entitled to process the data received about the buyer regarding or in connection with the business relationship, regardless of whether it comes from the buyer himself or from third parties, in accordance with the Federal Data Protection Act.
10.2. Personal customer data is treated confidentially and is not passed on to third parties.

1. Changes to Terms and Conditions

11.1. We reserve the right to change the terms and conditions at any time. The general terms and conditions as published in the online shop apply. For purchase orders that were placed before the amended terms and conditions came into force, the previous terms and conditions apply even after the amended terms and conditions come into force.

1. Place of jurisdiction

12.1. Arbon is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
